Rythmic Privacy Policy
These Terms and Conditions for the Rythmic Master Services Agreement (the “Terms”), together with all enrollment forms and Orders submitted by Customer, are the Master Services Agreement (the “Agreement”) that governs Customer’s use of the Rythmic Services whether free, paid, subscription, beta, or trial.
THE PERSON SIGNING THE AGREEMENT, CLICKING A BOX INDICATING ACCEPTANCE, EXECUTING AN ORDER, OR USING THE
SERVICES (WHETHER PAID, BETA, OR FREE) ACKNOWLEDGES THAT THEY HAVE READ THIS AGREEMENT, INCLUDING SECTION
13 THAT REQUIRES THE USE OF BINDING ARBITRATION TO RESOLVE DISPUTES RATHER THAN JURY TRIALS OR CLASS
ACTIONS, AND REPRESENTS THAT THEY HAVE THE AUTHORITY TO BIND THE CUSTOMER.

Rythmic (referred to in this Privacy Policy as “ Rythmic”, “we”, “us”, or “our”) has two separate
marketing/advertising functions. Firstly, we market our customers’ (auto dealers) inventory to shoppers
currently searching the Internet with the intent to purchase, and secondly, we acquire clients that are
interested in using the Rythmic AI and machine learning technology (the “AI Services”). This Privacy
Policy divides up our two functions below into their own sections to describe how we collect, use and
share the information gathered under these two functions.
In addition to our primary
functions described above, Rythmic may collect information on our website www.rythmic.co and its
subdomains (collectively, the “Website”) such as Google Analytics data.

For purposes of this Privacy Policy, “Personal Information” means information that identifies you as an
individual, for example your name, street address, telephone number, e-mail address and credit card
number, and other unique identifiers (such as a unique cell phone device ID). That definition
may be broader than similar definitions used under applicable privacy laws because we want to be more
inclusive and provide you with notice of the information we collect. If you opt not to provide us with
your Personal Information, you can still access our Website. However, in order to use certain
functionalities on the Website, activate or use a service, have a request to enroll in services
fulfilled or receive product information you may need to provide your Personal Information to
Rythmic.
This Privacy Policy applies to information, including Personal Information, that
Rythmic collects through your use or interaction with our Website, applications, chat bot, social media,
software, AI Services, job application and recruitment process, and other products or services provided
by or on behalf of Rythmic (collectively “ Rythmic General Services” or “General Services”). Please see

Notice to citizens of the EU visiting our Website or Affiliated Websites: Rythmic does not offer
products or services to citizens of the EU.

Website or Affiliated Websites. Rythmic is not responsible for the privacy practices of these third

The information we collect through our General Services, including through use of our chat feature, may
include all or some of the following:

address, phone number, etc.) (only if you give that to us to sign up for services, request information
or make an inquiry);

Services or third-party services, including geo-location, phone number, and other unique identifiers
(such as a unique cell phone device ID);

How We Use Google User Data
We use Google user data solely for the purpose of analytics reporting and analysis to understand user engagement and improve our services. This data helps us gain insights into how our users interact with our platform, allowing us to enhance features and optimize user experience.
Sharing and Disclosure of Google User Data
Rythmic does not share, transfer, or disclose any Google user data with any third-party company unless we explicitly render their services for the express purpose of conducting further analysis on this data. In such cases, these third-party service providers are contractually bound to maintain the confidentiality and security of your data, adhering to privacy standards no less stringent than our own.
Data Protection Mechanisms for Google User Data
We are committed to safeguarding your personal information. When handling Google user data, Rythmic adheres to PII (Personally Identifiable Information) data best practices. This means we implement robust security measures to protect your data from unauthorized access, alteration, disclosure, or destruction. We process all personal information with the utmost care and in accordance with applicable privacy regulations.
Retention and Deletion of Google User Data
Rythmic does not store or retain any Google user data on our own systems. Instead, we operate within Google's ecosystem, accessing and utilizing the data directly from there. This means your Google user data remains within Google's secure environment. Once you revoke access to your data within Google's ecosystem, we immediately lose access to it and can no longer view or use it.
